With summer and the sun, come also the risks of fires in the driest regions of France. To prevent this, the law requires the clearing of brush in certain areas. Owners are required to carry out this work.
Definition of brushwood clearing.
The forestry code defines brush clearing by article L. 131-10, created by Ordinance n°2012-92 of 26 January 2012 – art. (V) (links on Légifrance)
For the purposes of this title, brush clearing shall mean operations to reduce plant fuels of any kind in order to reduce the intensity and limit the spread of fires. These operations ensure a sufficient break in the continuity of the vegetation cover. They may include the pruning of maintained subjects and the elimination of slash.
The representative of the State in the department decides on the modalities for the implementation of brushwood clearing according to the nature of the risks.
Mandatory brush clearing in the Var.
Brushwood clearing is mandatory in wooded communes whose forests are either classified by administrative decision as particularly exposed to fire, or included in the forest massifs listed by the Forestry Code and located in the regions of Aquitaine, Corsica, Languedoc-Roussillon, Midi-Pyrénées, Poitou-Charentes, Provence-Alpes-Côte d’Azur, and the departments of Ardèche and Drôme.
Zones concerned by the regulation.
The legal obligations to clear brushwood apply to all the communes of the Var, in the following zones, defined in article 1 of the prefectoral order of March 30, 2015:
– woods, forests, plantations, reforestation, moors, scrubland and garrigues
– lands located at less than 200 meters from these formations
